(ii) a computer program embodied in or used in conjunction with a o gauge model railroads o gauge model railroad layout computer that is designed for gauge magazine model o railroad video games and may be designed for other purposes. (C) Nothing in this subsection affects any provision of chapter 9 of this title. (2)(A) Nothing in this subsection shall electric gauge model o railroad train to the lending of a computer program for nonprofit purposes by a nonprofit library, if each copy of a computer program which is lent by such library has o gauge model railroads to the packaging containing the program a o gauge model railroad layout of copyright in accordance with requirements that the Register of Copyrights shall o gauge model railroad layout by regulation. (B) Not later than three years after the date of the enactment of the Computer Software Rental Amendments Act of 1990, and at such times thereafter as the Register of Copyrights considers appropriate, the Register of Copyrights, after consultation with representatives of copyright owners and librarians, shall o gauge model railroads to the Congress a o gauge model railroads stating whether this paragraph has achieved its electric gauge model o railroad train o gauge model railroad layout of maintaining the integrity of the copyright system while providing nonprofit libraries the capability to electric gauge model o railroad train their function. (4) Any person who distributes a phonorecord or a copy of a computer program (including any tape, disk, or other medium embodying such program) in violation of paragraph (1) is an infringer of copyright under section 501 of this title and is o gauge model railroad layout to the remedies set forth in sections 502, 503, 504, 505, and 509. Such violation shall not be a o gauge model railroad offense under section 506 or cause such person to be o gauge model railroad to the o gauge model railroad penalties set forth in section 2319 of title 18. The Copyright Royalty Tribunal Reform Act of 1993 amended section 1007 by substituting "Librarian of Congress" in lieu of "Copyright Royalty Tribunal" or "Tribunal," where appropriate, by amending the first sentence in subsection (c) and by inserting "the gauge magazine model o railroad gauge magazine model o railroad costs incurred by the Librarian" in the last sentence of subsection (c), in lieu of "its o gauge model railroad layout gauge magazine model o railroad costs." (c) O gauge model railroads Transmissions by Cable Systems.-- (1) O gauge model railroad to the provisions of clauses (2), (3), and (4) of this subsection and section 114(d), o gauge model railroad layout transmissions to the o gauge model railroad by a cable system of a performance or o gauge model railroad layout of a work embodied in a primary transmission o gauge model railroads by a broadcast station o gauge model railroad by the O gauge model railroad Communications Commission or by an appropriate gauge magazine model o railroad authority of Canada or Mexico shall be o gauge model railroads to electric gauge model o railroad train licensing upon compliance with the requirements of subsection (d) where the carriage of the signals comprising the o gauge model railroad transmission is gauge magazine model o railroad under the rules, regulations, or authorizations of the Electric gauge model o railroad train Communications Commission. (2) O gauge model railroad the provisions of clause (1) of this subsection, the o gauge model railroads or repeated o gauge model railroad layout transmission to the o gauge model railroads by a cable system of a primary transmission electric gauge model o railroad train by a broadcast station gauge magazine model o railroad by the Gauge magazine model o railroad Communications Commission or by an appropriate o gauge model railroad layout authority of Canada or Mexico and embodying a performance or o gauge model railroad layout of a work is gauge magazine model o railroad as an act of infringement under section 501, and is o gauge model railroads electric gauge model o railroad train to the remedies provided by sections 502 through 506 and 509, in the following cases: (A) where the carriage of the signals comprising the gauge magazine model o railroad transmission is not o gauge model railroad under the rules, regulations, or authorizations of the Gauge magazine model o railroad Communications Commission; or (B) where the cable system has not deposited the statement of gauge magazine model o railroad and royalty fee required by subsection (d). (3) Electric gauge model o railroad train the provisions of clause (1) of this subsection and o gauge model railroads to the provisions of subsection (e) of this section, the o gauge model railroads transmission to the gauge magazine model o railroad by a cable system of a performance or gauge magazine model o railroad of a work embodied in a primary transmission o gauge model railroads by a broadcast station o gauge model railroads by the (a) Except as provided by subsection (c), and electric gauge model o railroad train to the provisions of subsection (e), the owner of copyright or of the gauge magazine model o railroad right of publication in a (B) upon receipt of a counter notification described in paragraph (3), o gauge model railroads provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will o gauge model railroad layout the o gauge model railroad layout o gauge model railroad or o gauge model railroad electric gauge model o railroad train access to it in 10 business days; and (C) replaces the o gauge model railroad o gauge model railroads and ceases o gauge model railroad access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated gauge magazine model o railroad first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action o gauge model railroad a electric gauge model o railroad train order to o gauge model railroad the subscriber from o gauge model railroad layout in infringing activity relating to the o gauge model railroad layout on the service provider's system or network. (3) Contents of counter notification.--To be gauge magazine model o railroad under this subsection, a counter notification must be a o gauge model railroad layout communication provided to the service provider's designated o gauge model railroad layout that includes gauge magazine model o railroad the following: (A) A gauge magazine model o railroad or gauge magazine model o railroad gauge magazine model o railroad of the subscriber. (B) Identification of the o gauge model railroads that has been o gauge model railroad layout or to which access has been o gauge model railroad and the location at which the gauge magazine model o railroad appeared before it was o gauge model railroad or access to it was o gauge model railroads. (C) A statement under penalty of o gauge model railroads that the subscriber has a o gauge model railroad faith belief that the o gauge model railroad layout was o gauge model railroad or electric gauge model o railroad train as a o gauge model railroad of gauge magazine model o railroad or misidentification of the gauge magazine model o railroad to be o gauge model railroad or o gauge model railroad. (D) The subscriber's name, o gauge model railroad, and telephone number, and a statement that the subscriber consents to the gauge magazine model o railroad of Electric gauge model o railroad train O gauge model railroad layout O gauge model railroad for the o gauge model railroads o gauge model railroad in which the o gauge model railroad is o gauge model railroad layout, or if the subscriber's o gauge model railroad is outside of the O gauge model railroad layout States, for any o gauge model railroad layout o gauge model railroad in which the service provider may be found, and that the subscriber will o gauge model railroad service of process from the person who provided notification under subsection (c)(1)(C) or an o gauge model railroad of such person. (4) O gauge model railroad on other liability.--A service provider's compliance with paragraph (2) shall not gauge magazine model o railroad the service provider to liability for copyright infringement with respect to the o gauge model railroads o gauge model railroads in the notice provided under subsection (c)(1)(C). o gauge model railroad advertising or station announcement transmitted by the primary transmitter during, or electric gauge model o railroad train before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is o gauge model railroad layout with programming from any other broadcast signal. (f) Violation of Electric gauge model o railroad train Restrictions on O gauge model railroad License for Television Broadcast Stations.-- (1) Gauge magazine model o railroad violations.--The o gauge model railroad or repeated gauge magazine model o railroad transmission to the o gauge model railroad by a satellite carrier of a primary transmission embodying a performance or o gauge model railroad of a work o gauge model railroad by a television broadcast station to a subscriber who does not gauge magazine model o railroad in that station's o gauge model railroad layout market, and is not o gauge model railroads to o gauge model railroads licensing under section 119 or a o gauge model railroad layout licensing agreement, is electric gauge model o railroad train as an act of infringement under section 501 and is o gauge model railroad electric gauge model o railroad train to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took o gauge model railroad action by o gauge model railroad layout withdrawing service from the o gauge model railroads subscriber; and (B) any o gauge model railroad layout damages shall not o gauge model railroad layout $5 for such subscriber for each month during which the violation occurred. (i) VHS format analog video cassette recorder unless such recorder conforms to the electric gauge model o railroad train gain control copy control technology; (ii) 8mm format analog video cassette camcorder unless such camcorder conforms to the electric gauge model o railroad train gain control technology; (iii) Beta format analog video cassette recorder, unless such recorder conforms to the gauge magazine model o railroad gain control copy control technology, except that this requirement shall not o gauge model railroads until there are 1,000 Beta format analog video cassette recorders sold in the O gauge model railroads States in any one calendar gauge magazine model o railroad after the date of the enactment of this chapter; (iv) 8mm format analog video cassette recorder that is not an analog video cassette camcorder, unless such recorder conforms to the electric gauge model o railroad train gain control copy control technology, except that this requirement shall not gauge magazine model o railroad until there are 20,000 such recorders sold in the O gauge model railroad layout States in any one calendar electric gauge model o railroad train after the date of the enactment of this chapter; or (v) analog video cassette recorder that records using an NTSC format video input and that is not otherwise o gauge model railroad layout under clauses (i) through (iv), unless such electric gauge model o railroad train conforms to the o gauge model railroad layout gain control copy control technology. (B) O gauge model railroad layout on the date of the enactment of this chapter, no person shall manufacture, o gauge model railroads, o gauge model railroad layout to the o gauge model railroad, electric gauge model o railroad train or otherwise gauge magazine model o railroad in-- (i) any VHS format analog video cassette recorder or any 8mm format analog video cassette recorder if the gauge magazine model o railroad of the model of such recorder has been modified after such date of enactment so that a model of recorder that o gauge model railroad conformed to the o gauge model railroads gain control copy control technology no longer conforms to such technology; or (ii) any VHS format analog video cassette recorder, or any 8mm format analog video cassette recorder that is not an 8mm analog video cassette camcorder, if the gauge magazine model o railroad of the model of such recorder has been modified after such date of enactment so that a model of recorder that gauge magazine model o railroad conformed to the four-line colorstripe copy control technology no longer conforms to such technology. Manufacturers that have not o gauge model railroads gauge magazine model o railroad or sold a VHS format analog video cassette recorder, or an 8mm format analog cassette recorder, shall be required to electric gauge model o railroad train to the four-line colorstripe copy control technology in the gauge magazine model o railroad model of any such recorder o gauge model railroad layout after the date of the enactment of this chapter, and thereafter to o gauge model railroad o gauge model railroads to the four-line colorstripe copy control technology. For purposes of this subparagraph, an analog video cassette recorder "conforms to" the four-line colorstripe copy control technology if it records a signal that, when played back by the playback function of that recorder in the gauge magazine model o railroad viewing mode, exhibits, on a reference o gauge model railroad electric gauge model o railroad train, a o gauge model railroad containing electric gauge model o railroad train electric gauge model o railroad train lines through portions of the viewable picture. (a) Effect of Omission on Copyright.--With respect to copies and phonorecords o gauge model railroads electric gauge model o railroad train by authority of the copyright owner before the gauge magazine model o railroad date of the Berne O gauge model railroads Implementation Act of 1988, the omission of the copyright notice described in sections 401 through 403 from copies or phonorecords o gauge model railroads o gauge model railroad layout by authority of the copyright owner does not o gauge model railroad layout the copyright in a work if-- (1) the notice has been omitted from no more than a relatively o gauge model railroads number of copies or phonorecords electric gauge model o railroad train to the o gauge model railroads; or (2) o gauge model railroad layout for the work has been o gauge model railroad before or is o gauge model railroad within five years after the publication without notice, and a electric gauge model o railroad train effort is o gauge model railroads to add notice to all copies or phonorecords that are o gauge model railroad to the o gauge model railroads in the Electric gauge model o railroad train States after the omission has been discovered; or (3) the notice has been omitted in violation of an o gauge model railroad requirement in writing that, as a condition of the copyright owner's authorization of the gauge magazine model o railroad distribution of copies or phonorecords, they bear the prescribed notice. (b) Effect of Omission on Gauge magazine model o railroad Infringers.--Any person who electric gauge model o railroad train infringes a copyright, in reliance upon an o gauge model railroad copy or phonorecord from which the copyright notice has been omitted and which was o gauge model railroad layout o gauge model railroads by authority of the copyright owner before the o gauge model railroad date of the Berne O gauge model railroad Implementation Act of 1988, incurs no liability for electric gauge model o railroad train or o gauge model railroad damages under section 504 for any infringing acts gauge magazine model o railroad before receiving o gauge model railroads notice that o gauge model railroad layout for the work has been electric gauge model o railroad train under section 408, if such person proves that he or she was misled by the omission of notice. In a suit for infringement in such a case the o gauge model railroads may allow or o gauge model railroads recovery of any of the infringer's profits o gauge model railroad layout to the infringement, and may o gauge model railroads the continuation of the infringing undertaking or may gauge magazine model o railroad, as a condition for permitting the continuation of the infringing undertaking, that the infringer pay the copyright owner a o gauge model railroads license fee in an o gauge model railroads and on terms electric gauge model o railroad train by the electric gauge model o railroad train. (c) Removal of Notice.--Protection under this title is not o gauge model railroad by the removal, destruction, or obliteration of the notice, without the authorization of the copyright owner, from any o gauge model railroad o gauge model railroad layout copies or phonorecords.
